ARC ATHLETE CODE OF CONDUCT
Alpine Racing Collective (hereinafter referred to as "ARC") is committed to upholding a standard of conduct characterized by exemplary behavior, sportsmanship, good citizenship, and unwavering alignment with the core values espoused by ARC. The actions of individual athletes within our esteemed organization possess the capacity to either enhance or significantly compromise the reputation of ARC. Consequently, each and every athlete privileged to be a part of ARC hereby solemnly agrees to adhere to the following stipulations:
Athletes representing ARC shall unfailingly comport themselves in strict accordance with the program's cherished values of integrity, respect, teamwork, and accountability.
Athletes are mandated to demonstrate unwavering respect toward coaches, officials, parents, teammates, ski resort staff, and fellow competitors, irrespective of the circumstances, and shall abstain from any behavior that may be construed as disrespectful towards any of these individuals or the collective entity of the team.
Athletes are expected to consistently exhibit commendable sportsmanship during all training sessions and competitions, and they commit to obeying the instructions provided by coaches and officials while engaged in the field of play.
Athletes shall refrain from any indulgence in tobacco, alcohol, or illicit drugs.
The use of profane, abusive, or otherwise objectionable language or expressions within the team environment is strictly prohibited.
Acts of bullying, hazing, or any form of emotional or physical abuse directed towards fellow teammates shall not be tolerated.
Athletes shall exercise discretion and restraint in their use of social media, refraining from posting messages or images that could cast a negative light on themselves, any other individuals, ARC, or any affiliated partners.
Athletes are required to meticulously adhere to the guidelines delineated within the ARC Handbook, in addition to fulfilling all athlete responsibilities, team-related obligations, travel regulations, and educational policies.
Athletes participating in events sanctioned by USSA shall adhere to the prescribed Code of Conduct guidelines set forth by the respective governing bodies.
Athletes unequivocally commit to complying with all applicable national and/or international laws.
In every interaction with employees and property of UOP, Deer Valley, or any ski resort or accommodation, athletes shall exhibit the utmost respect and courtesy.
Furthermore, all ARC athletes are bound by the rules and regulations promulgated by the governing bodies presiding over their respective sports.
ARC ATHLETE CODE OF CONDUCT VIOLATIONS OF RULES, DISCIPLINE, AND APPEALS
Membership within the Alpine Racing Collective ("ARC") is a privilege, not an entitlement. Each athlete fortunate enough to be a member of ARC is entrusted with the responsibility to conduct themselves in a manner that
(i) embodies the highest standards of personal conduct and sportsmanship,
(ii) upholds the reputation of ARC, and
(iii) aligns with the ARC Athlete Code of Conduct and the codes stipulated by their relevant governing bodies.
Any infraction of the rules may result in disciplinary action, the nature of which will be determined following a thorough evaluation of the individual, the intent, and the surrounding circumstances. It is imperative to note that the disciplinary process outlined below is not necessarily linear, and multiple steps may be invoked in response to a singular violation, contingent upon the severity of the transgression.
MAJOR OFFENSES
Major Offenses are defined as actions of a grave nature that contravene the ARC Athlete Code of Conduct or the regulations of any governing body, or actions that jeopardize the mental or physical health, safety, or well-being of oneself or others. Such actions encompass, but are not limited to:
* Conviction of a misdemeanor or a felony.
* Assault and Battery.
* Theft or Larceny.
* Usage of Illegal Drugs or Alcohol (refer to the Drug & Alcohol Policy).
* Deliberate falsehoods when pertaining to any of the aforementioned Major Offenses. Other instances of falsehoods will be assessed on a case-by-case basis.
The repercussions for any rule violation categorized as a major offense may include immediate dismissal from the team. At the very least, an athlete found culpable of a major offense shall be subject to the following measures:
1. First Offense during a competition season (June 1st through April 30th) - Mandatory suspension from all team activities and races for a duration of three weeks, in addition to 30 hours of community service. Such additional consequences as deemed reasonable and necessary under the circumstances by the Program Director, in consultation with the Executive Director, shall also be imposed. The community service must be performed for a locally approved non- profit organization.
Second Offense within a competition season - Immediate dismissal from the team for the remainder of that season.
Any athlete dismissed from the program pursuant to the aforementioned procedures may submit a written request to rejoin the team for a subsequent competition season. The Program Director will assess this request and may opt to
(i) reinstate the athlete for the upcoming season,
(ii) delay reinstatement for a designated period, and/or
(iii) impose reasonable conditions on the athlete's continued affiliation with the program (e.g., requiring the athlete to forfeit their membership in the event of any future major offense).
The disciplinary actions for Major Offenses shall primarily fall within the purview of the Program Directors, who may initiate disciplinary proceedings based on information sourced from reliable channels, provided that such information substantially supports the need for such action. The Program Director shall furnish written notice (the "Notice") of the proposed disciplinary action to the athlete and their parent/guardian/custodian. This Notice shall encompass the following elements: (i) citation of any rules, laws, codes of conduct, or policies allegedly breached by the athlete;
(ii) a factual elucidation of the allegation; and
(iii) the maximum potential sanctions, in tandem with any recommended course of action.
Within forty-eight (48) hours of receiving the Notice, the athlete and/or their parent/guardian/custodian may submit clear and convincing evidence of extenuating circumstances or exculpatory evidence to the Program Director for consideration, pending a final determination. Following the expiration of the 48-hour window, the Program Director shall issue a written decision (the "Decision") outlining the disciplinary measures to be imposed. This Decision shall be personally delivered to the athlete and their parents/guardians/custodians through means such as hand delivery, email, overnight delivery services, or other similar, verifiable delivery methods.
It is noteworthy that if an athlete is dismissed from the program or an event while traveling, they may be promptly sent home at the expense of their parents, employing the most convenient means available. However, the Program Director shall, in such cases, provide immediate oral notice to the athlete and their parent/guardian/custodian and furnish the written Decision within forty-eight (48) hours after taking such action. No refunds of program or event fees shall be granted.
MINOR OFFENSES
Minor Offenses are characterized as violations of the rules delineated within the Athlete Code of Conduct, including but not limited to:
* Violations of any Team Partner Venue Rules.
* Violations of the Athlete Code of Conduct.
* Violations of Travel Rules.
* Violations of School/Academic Rules.
* Sanctions for Minor Offenses will be determined by the coaches and Program Director, in adherence to the ensuing guidelines:
* First Offense: A one-week suspension from all team activities and/or a missed opportunity to participate in the next available race or competition.
* Second Offense: A three-week suspension and/or missed participation in the next available race(s) or competition.
* Third Offense: Indefinite suspension or expulsion from the team, with such action to be treated as a Major Offense.
In the event of a disciplinary action stemming from a minor offense, the Program Director shall provide written notice of the disciplinary action to the athlete and their parent/guardian/custodian. This notice will encompass the following details:
(i) citation of any rules, laws, codes of conduct, or policies allegedly breached by the athlete;
(ii) a factual explication of the allegation; and
(iii) the maximum potential sanctions, alongside any recommended course of action. Notice of a disciplinary action shall be conveyed to the athlete and their parents/guardians/custodians via email, overnight delivery services, or other similar, verifiable delivery methods.
APPEALS
All disciplinary actions and/or sanctions imposed by ARC rules and policies are subject to appeal by the athlete, in accordance with the specified timeframe and procedures delineated below. The athlete possesses the right to receive adequate notice of any disciplinary action and/or sanction, inclusive of the grounds upon which it is based, and is entitled to a hearing before the Safety Committee. The Safety Committee shall comprise solely of the Program Director.
Within forty-eight (48) hours of receiving the Decision or notice of any disciplinary action for minor offenses, the athlete and/or their parent/guardian/custodian (collectively referred to as the "Appellant") must submit a written appeal to the Safety Committee, seeking a comprehensive review and assessment of the Decision or action. Failure to initiate a timely appeal shall be construed as a waiver of the right to appeal. The Appellant may petition for a formal hearing before the Safety Committee, and, in the event that the Decision is rendered (or the action taken) during the competition season, the Appellant may request an expedited hearing. During the hearing, the Appellant shall have the opportunity to present their case against the Decision or action, while the Program Director shall be afforded the chance to advocate for the Decision or action. Upon the conclusion of the hearing, the Safety Committee shall issue a ruling that may affirm, modify, or reverse the Decision or action.
In the event that the Safety Committee decides to deliberate further to obtain additional pertinent information, a ruling shall be issued as expeditiously as possible, but under no circumstances later than thirty (30) days from the date of the hearing.
